The Faculty of Social Sciences is pleased to highlight the recent publication by Professor Richard Dub茅, Department of Criminology: The Judicial Traditionalization of Modern Penal Rationality: An Ontological Hurdle to Evolution.

In this French-language paper, Professor Dub茅 examines the dynamics of sentencing through a phenomenological lens, drawing inspiration from Max Weber鈥檚 modes of orientation that guide social activity. His analysis brings to light a new obstacle to the evolution of modern criminal law鈥攐ne that is ontological rather than cognitive. Instead of focusing solely on ways of thinking or acting, the article questions the very ways of being that underpin judicial practice.

By situating sentencing within this broader ontological framework, the paper contributes to critical debates on how criminal law evolves, and the deeper forces that may inhibit or sustain change.
